General Terms and Conditions
These Terms and Conditions ("Service Terms") govern the use of the auction platform (hereinafter "Website") operated by Bronline OÜ (hereinafter "Bronline" or "Seller") by a registered member (hereinafter "Member"). Bronline owns and operates the auction platform located at www.bronline.eu and its related pages.
The terms apply to all Members and all services provided by Bronline (hereinafter "Services"). A Member can access Bronline’s Services only if the Member has explicitly accepted these Terms.
By accepting these Terms, the Member or their representative agrees to the following: to comply with the Service Terms, the processing of their personal data, and to accept the use of cookies in accordance with Bronline’s Privacy Policy ("Privacy Policy"). The Service Terms, Privacy Policy, price list, and the information provided on the Website constitute a comprehensive agreement between the Member and Bronline.
The Member undertakes to refrain from any activities that may negatively affect the reliability of the Website and/or cause direct material damage to other Members or Bronline. This obligation includes, but is not limited to: making sham bids to benefit the owner or otherwise distort the auction price; listing an item without the right to sell or transfer ownership, etc.
Bronline reserves the right to update and amend the Service Terms, price list, and Privacy Policy at its discretion at any time. Members will be notified of significant updates to these documents, including the Privacy Policy, via the Website.
The Website and all its content are the property of Bronline and protected by copyright laws. Unauthorized use or partial or full copying of the Website and Services may constitute an unlawful violation of Bronline’s intellectual property rights and may result in claims for damages.
Membership
To access the Website and use Bronline’s Services, a user must complete the membership registration process, which is treated as an application for access to the Website. Registration is free of charge.
Membership requires the Member to be at least 18 years of age.
After reviewing the membership application, Bronline may accept or reject the application. If the application is accepted, an account (User Account) is created for the Member, where all relevant data is entered. After the membership application is approved, Bronline sends the Member an email with instructions for activating the User Account.
Bronline processes the Member's personal data provided to Bronline. The terms regarding how Bronline handles and processes the personal data submitted by the Member are outlined in the Privacy Policy, which is an integral part of these Terms.
The Member must provide sufficient, accurate, and up-to-date personal information in the membership application and maintain the accuracy of this information throughout the membership period. The Member is solely responsible for any inaccuracies, errors, or outdated personal data and any potential damages arising from such information.
The User Account is personal and must not be shared with other individuals. Members are fully responsible for the security of their User Account access credentials. A Member can access the Website only by using the correct email address.
Bronline is not liable for damages caused by unauthorized use of the Member’s login credentials.
For security reasons, Bronline has the right to require a change of the Member's login credentials at any time.
Bidding
Only registered and approved Members by Bronline are entitled to bid on items listed on the Website ("Items"). Bidding is free of charge.
The Item is sold in the condition described in the auction description. Members are required to review the Item description before placing a bid.
Bronline ensures that all bids are public and timely, and Members can monitor the highest bid throughout the auction. Members can place bids until the auction deadline according to Bronline's instructions and conditions.
If the item has a reserve price and the reserve price is met, the seller commits to selling the item to the highest bidder. If the reserve price is not met, the seller reserves the right to accept or reject the highest bid.
All Bronline auctions initially have a fixed deadline, which, upon reaching, is extended by an additional 3-minute period. The auction continues and closes when no new bids are placed within 3 minutes after the original deadline. Each subsequent bid extends the auction by an additional 3 minutes.
The highest bidder ("Buyer") is obligated to purchase the auctioned Item if they are the highest bidder at the end of the auction and the reserve price has been met.
Bronline may set a minimum purchase price for the Item ("Reserve Price"). The Website indicates whether a reserve price applies to the auction. Members may bid below the Reserve Price, but this does not obligate Bronline to sell the Item. Items whose reserve price is not met at auction may be relisted by Bronline.
Bronline will usually contact the Buyer within 1 business day after the end of the auction via email or phone. The Buyer is issued an invoice, which includes the Item price and any fees charged by Bronline. If the Buyer cannot be reached after reasonable attempts within 3 business days following the auction's end, particularly if the Buyer has not confirmed receipt of the prepayment invoice, Bronline will void the bid and may start offering the Item to other auction participants based on the next highest bid. The account of the bidder who placed the voided bid will be closed, and they will be issued an invoice for a penalty fee. The penalty fee is 10% of the purchase price, but at least €100 excluding VAT or at least €122 including VAT.
Listing Items and Auction Descriptions
The Item listed on the Website is presented on behalf of a representative (hereinafter "Owner").
Bronline's responsibilities include evaluating the Item and preparing its description (hereinafter "Description"). Bronline does not perform a detailed technical inspection of the Item, and the Description is based solely on a visual inspection and the information provided by the Owner. Bronline is not responsible for damages resulting from inaccurate, incorrect, or insufficient Descriptions provided by the Owner.
Members have the right to inspect the condition of the Item on-site at the time specified in the Description.
The Buyer must accept minor faults and defects in the Item, even if they are not mentioned in the Description. Such defects may include, but are not limited to: the absence of a spare tire, tire repair kit, jack, tools, maintenance, and repair documents, floor mats, hubcaps, minor paint damage on the Item’s panels, etc. These defects are not considered a breach of contract and do not entitle the Buyer to request contract termination or compensation.
All delivery costs related to the Item and its associated documents, including shipping fees, are the responsibility of the Buyer unless stated otherwise. The transportation of the Item, including all necessary export documents, is the Buyer's responsibility unless explicitly agreed otherwise by the Owner and the Buyer.
Liability and Dispute Resolution
Bronline acts as a third party in the transaction between the Owner and the Buyer. Bronline is not responsible for direct or indirect damages resulting from the transaction, including but not limited to damages related to the condition of the Item or its Description.
Members agree to indemnify Bronline against damages arising from claims by third parties related to or resulting from the Member’s actions or omissions while using the Website, including but not limited to claims arising from inaccurate, incorrect, or outdated personal information provided by the Member.
All disputes arising from or related to the use of the Website will be resolved in accordance with the laws of the Republic of Estonia. The Member and Bronline will attempt to resolve all disputes through negotiations. If no agreement is reached through negotiations, disputes will be resolved in the Harju County Court.
Auction Rules
Bids on auctions are ranked based on the bid amount and the time of submission. All auctions have a defined bidding increment. All bids are legally binding. Bids below the reserve price remain binding for 72 hours after the auction ends. If a bid is accepted, you will be notified within 72 hours. If your highest bid is not accepted, no feedback will be provided by the Seller.
Automatic Bidding
Enter the maximum amount you are willing to bid in the automatic bidding field and place your bid. By using automatic bidding, your bid amount will automatically increase by the smallest allowed increment each time someone outbids your current bid, up to your maximum bid amount. If someone places a higher bid than your maximum, you will be notified by email.
Automatic bids are marked with the letter (A). If you want to change your automatic bid or add an automatic bid to an auction where you are the leading bidder, the automatic bid must be at least one increment higher than your current bid.
Last-Minute Bidding
If a bid is placed during the last 3 minutes of an auction, the auction time is automatically extended by an additional 3 minutes from the time the bid is placed. This continues until no new bids are placed.
Reserve Price
Most auctions have a reserve price. If the highest bid at the end of the auction equals or exceeds the reserve price, the Item is sold. If the highest bid is below the reserve price, the Seller has 72 hours to inform the bidder whether the bid is accepted.
Outbidding
If someone places a bid higher than yours, you will be notified by email. We recommend carefully monitoring the auction during the last hour. If you are outbid, you will receive a notification via email.
If you see that you are immediately outbid after placing your bid, it is likely because someone has placed an automatic bid (A), meaning your bid is immediately outbid (see "Automatic Bidding"). The detailed auction view shows the entire bidding history. All bids are associated with a customer bid number.
Tied Bids
If you place a bid against an automatic bid, a situation may arise where the bid amounts are the same (your bid matches the maximum amount of the automatic bid). In the case of tied bids, the oldest bid made during the auction or the winning bid at the auction's conclusion will be considered the leader.
